We assist with the sale and purchase of both residential and commercial property in the Cayman Islands as well as large-scale commercial developments, Cayman mortgages and financing, leasing and share transfers. Our real estate lawyers offer advice to both borrowers and lenders for each stage of the deal and on all aspects of Cayman property law. You may choose to utilise a Cayman company for holding your Cayman property and we can help you to set this up and open any required bank accounts.
Both Caymanians and non-Caymanians are able to own Cayman real estate. There are several incentives for Caymanian first-time buyers. Non-Caymanians wishing to invest in residential real estate can choose from a variety of highly desirable locations and can opt to purchase standalone homes, condos and timeshares. It is also possible to purchase land and build your own home with the assistance of highly trained local service providers in the Cayman construction industry. The Cayman Government has occasionally offered incentives for construction in the form of lowered import duties on construction materials.
Cayman Stamp Duty
In the Cayman Islands, stamp duty is payable for the purchase of both land and constructed buildings. With the passage of the Stamp Duty Law 2012, stamp duty on property was set at 7.5% of consideration or market value for all areas on the three Cayman Islands, except for certain Caymanian first-time buyers. The stamp duty paid by a first-time Caymanian buyer depends on the value of the land or property.
